TERMS & CONDITIONS

Welcome to J&K Printing & Design ("Company," "we," "us," or "our"). These Terms & Conditions ("Terms") govern your use of our website, services, and purchase of custom print, design, and marketing products.

By placing an order, requesting a quote, or using our services, you agree to be bound by these Terms. Please read them carefully.

1. Orders & Quotations

  • Quotations: Written or verbal estimates are valid for 30 days from the date issued, unless otherwise stated. Prices are subject to change based on actual file reviews or modifications to project specifications.

  • Order Acceptance: An order is considered accepted only after we receive explicit written confirmation (or proof approval) and agreed payment terms.

  • Order Cancellations: Requests to cancel an order must be submitted in writing. Orders cancelled after proof approval or commencement of production will be billed for all work completed, materials allocated, and labor incurred up to the time of cancellation.

2. Digital Proofing & Customer Approval

  • Proof Review: We provide digital or physical proofs for custom print projects. It is the customer's responsibility to carefully review all aspects of the proof, including text spelling, grammar, layout, dimensions, image placement, and colors.

  • Approval Authority: Production begins only after written proof approval is received. J&K Printing & Design is not responsible for errors present in the approved proof that were not corrected by the customer prior to production.

  • Customer-Supplied Artwork: We assume provided artwork files are print-ready (proper resolution, bleed settings, CMYK color profiles, and embedded fonts). Additional file preparation or corrections requested by the customer may incur design/prepress fees.

3. Color Accuracy, Finishing, & Print Tolerances

  • Color Matching: On-screen colors (RGB) differ from printed colors (CMYK). While we utilize state-of-the-art press technology and color management, exact color matching to a monitor display cannot be guaranteed. Spot/Pantone (PMS) matching must be requested in advance.

  • Manufacturing Variations: Commercial printing is subject to industry-standard variances in paper weight, trimming (typically $\pm 1/16$ inch), folding, binding, and color density throughout a run.

  • Quantity Tolerances: Due to the nature of custom manufacturing, overruns or underruns not exceeding 5% of the ordered quantity constitute acceptable delivery. Charges will be adjusted on a pro-rata basis if applicable.

4. Payment Terms & Billing

  • Payment Requirements: Unless credit terms have been formally approved in writing, orders must be paid in full or according to agreed deposit schedules prior to production or delivery.

  • Late Payments: Invoices not paid within agreed terms are subject to interest charges on the outstanding balance at the rate of 1.5% per month (or the maximum allowed by law).

  • Taxes: Prices do not include applicable local, state, or federal sales taxes unless explicitly itemized. Customers claiming tax-exempt status must provide a valid exemption certificate prior to invoicing.

5. Production, Shipping, & Delivery

  • Turnaround Times: Estimated completion and delivery dates are provided in good faith but are not guaranteed unless explicitly designated in writing as a firm deadline. Turnaround time begins after proof approval and receipt of payment.

  • Shipping & Freight: Risk of loss and title for all products pass to the customer upon delivery to the shipping carrier. We are not responsible for carrier delays, damage during transit, or loss beyond our reasonable control.

  • Local Pickup: Items scheduled for pickup at our Canton location must be retrieved within 30 days of completion notifications.

6. Intellectual Property & Indemnification

  • Customer Ownership: You retain full ownership of all copyrighted material, logos, trademarks, and artwork provided to us for printing.

  • Copyright Compliance: By submitting artwork, you warrant that you have full legal right and authorization to use and reproduce all submitted content.

  • Indemnification: You agree to defend, indemnify, and hold harmless J&K Printing & Design, its owners, and employees from any claims, damages, costs, or legal fees arising from copyright, trademark, or proprietary right infringements related to materials you submit for production.

7. Returns, Refunds, & Defective Work

  • Notice of Claims: Complaints regarding quality, defects, or shortages must be submitted in writing within 5 business days of receiving your shipment or pickup.

  • Remedies: If an order is determined to have manufacturing defects attributable to J&K Printing & Design, we reserve the right to reprint the job at no additional cost or issue a store credit. The return of the original defective product may be required before a reprint is issued.

  • Limitation of Liability: Our total liability for any claim, loss, or damage shall not exceed the actual invoice amount paid by the customer for the specific job in question. We are not liable for indirect, consequential, or lost profit damages.

8. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of the State of Ohio, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms shall be brought in the state or federal courts located in Stark County, Ohio.
